1. Acceptance of Terms

By engaging Medtracy AI or using our website or materials or email links, you agree to these Terms and Conditions (“Terms”).

2. Consultancy Services Only

Medtracy AI operates solely as a consultancy business.

We:

  • Provide recommendations, analysis, and general advice regarding third-party AI-powered software, platforms, and products

  • Do not provide AI services, software, systems, or tools

  • Do not act as an agent, partner, reseller, or representative of any third-party provider unless expressly stated in writing

3. No Endorsement or Guarantee

Any recommendation or discussion of a third-party product or service:

  • Is provided for general informational purposes only

  • Does not constitute an endorsement, warranty, or guarantee

  • Does not guarantee suitability, performance, compliance, availability, or outcomes

Third-party products and services may change without notice.

4. Independent Due Diligence Required

You acknowledge and agree that:

  • You are solely responsible for conducting your own independent due diligence

  • You must assess legal, technical, financial, security, privacy, and compliance risks yourself

  • You should obtain independent professional advice (legal, financial, technical, medical, or otherwise) before entering into any agreement

5. No Responsibility for Third-Party Contracts

Medtracy AI is not responsible or liable for:

  • Any contract, agreement, or commercial relationship you enter into with a third-party provider

  • Any loss, damage, cost, or consequence arising from the use of third-party products or services

  • Any acts, omissions, failures, data breaches, or service interruptions of third-party providers

All third-party engagements are entirely at your own risk.

6. No Professional Advice Disclaimer

Unless expressly stated in writing:

  • We do not provide medical, legal, financial, or regulatory advice

  • Nothing we provide should be relied upon as a substitute for qualified professional advice

7. Limitation of Liability

To the maximum extent permitted by law:

  • All warranties not required by the Australian Consumer Law are excluded

  • Medtracy AI is not liable for indirect, consequential, or economic loss

  • Our total liability is limited to the fees paid to us for the relevant consultancy services

Nothing in these Terms excludes rights that cannot be excluded under Australian law.

8. Intellectual Property

All materials created by Medtracy AI remain our intellectual property unless otherwise agreed in writing. You may not reproduce or distribute them without permission.

9. Termination

Either party may terminate an engagement in accordance with agreed terms. We may refuse or discontinue services where misuse or unlawful conduct occurs.

10. Governing Law

These Terms are governed by the laws of Australia, and the courts of the relevant Australian state or territory have exclusive jurisdiction.

11. Changes to Terms

We may update these Terms from time to time. Continued engagement constitutes acceptance of the updated Terms.
